Terms and Conditions
Effective date: 14 April 2026 — Version 1.0
These Terms of Use (“Terms”) govern your access to and use of the website located at https://nexwright.com and any subdomains operated by the same publisher (collectively, the “Website”). By accessing or using the Website you agree to be bound by these Terms. If you do not agree, do not use the Website.
The Website is operated by the publisher identified in the Imprint (“we”, “us”, “our”).
1. Nature of the Website
The Website is informational only. It is a company front page that describes the trading activity carried on under the brand name “NexWright” and the software product “J2G”.
- The Website does not execute any online purchase, booking, subscription, or service-contract workflow. No part of the Website constitutes a binding commercial offer.
- Service engagements (software development, DevOps, infrastructure, consulting) are scoped, negotiated, priced, and contracted individually between us and each client through separate written agreements (typically email correspondence followed by an invoice). Nothing on the Website fixes the terms of any such engagement.
- The J2G desktop application is distributed under its own end-user licence agreement (“EULA”), which is available at https://nexwright.com/projects/j2g/eula/ and is also shipped inside the application. Use of J2G is governed by the EULA, not by these Terms.
2. No Advice
Content published on the Website (articles, case studies, technical descriptions, architecture diagrams, benchmarks, product claims) is provided for general information. It does not constitute legal, tax, security, or professional advice and must not be relied upon as such. You are responsible for obtaining specific advice before acting on any information taken from the Website.
3. Intellectual Property
All text, graphics, logos, layouts, source code, documentation, and any other material published on the Website are either owned by us or licensed to us, and are protected by copyright, trademark, and related rights under the laws of Ukraine and international treaties.
- You may view the Website and make a reasonable number of temporary local copies (browser cache, single-device print) for personal, non-commercial reference.
- You may not reproduce, modify, translate, redistribute, publicly display, frame, scrape, or create derivative works from any part of the Website without our prior written consent.
- “NexWright” and “J2G” are trade names used by the publisher. No licence to use them is granted by the mere fact of visiting the Website.
See also our Copyright Notice.
4. Acceptable Use
You agree not to:
- Attempt to probe, scan, or test the vulnerability of the Website, nor breach or circumvent any authentication or security measure.
- Use any automated means (bots, crawlers, scrapers) to retrieve content at a rate or volume that impairs the Website’s availability for other users, or that violates
robots.txt. - Upload or transmit any material that is unlawful, defamatory, infringing, malicious, or that contains viruses or other harmful code.
- Use the Website to harass, stalk, or send unsolicited commercial communications.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
We may suspend or block access from any IP address, network, or user-agent at our discretion if we believe these rules are being violated.
5. Third-Party Links and Services
The Website may link to or reference third-party websites, products, or services (for example: GitLab, GitHub, Jenkins, AWS, Azure, Google Cloud, Kubernetes). Such references are for information only; they do not imply endorsement, sponsorship, or an affiliate relationship unless we state so explicitly. We are not responsible for the availability, content, or practices of third-party sites.
6. Privacy
Personal data collected through the Website (for example, when you send us an email from the contact form, or via server access logs) is processed in accordance with our Privacy Policy.
7. Cookies
The Website uses only strictly necessary cookies (session, security, consent state). We do not operate advertising, profiling, or cross-site-tracking cookies. If that ever changes, a consent banner will be displayed before any non-essential cookie is set.
8. Disclaimer of Warranties
THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profit, revenue, data, business opportunity, or goodwill, arising from or relating to your use of the Website — whether under contract, tort, statute, or any other theory, and even if advised of the possibility of such loss.
- Our aggregate liability arising out of or relating to the Website shall not exceed one hundred euros (EUR 100) or its UAH equivalent at the exchange rate applicable on the date the claim arose.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under mandatory law (for example, liability for gross negligence, wilful misconduct, or personal injury caused by our wilful act).
10. Changes to these Terms
We may amend these Terms from time to time. The current version is always available at this page with an effective date. Material changes take effect on the effective date shown; continued use of the Website after that date constitutes acceptance of the revised Terms. Archival versions are available on request.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules. Any dispute, controversy, or claim arising out of or relating to these Terms or the Website shall be submitted to the exclusive jurisdiction of the competent courts of Ukraine. This does not deprive consumers resident in another country of the protection of the mandatory provisions of the law of their country of habitual residence.
12. Miscellaneous
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Entire agreement. These Terms (together with the Privacy Policy and, where relevant, the J2G EULA) constitute the entire agreement between you and us concerning your use of the Website.
- Assignment. You may not assign these Terms. We may assign them in connection with a reorganisation, merger, or transfer of the trading activity.
- Force majeure. We are not liable for any failure or delay due to events beyond our reasonable control, including war, armed conflict, power or internet outage, natural disaster, labour dispute, or any lawful act of a governmental authority.
- Notices. Notices to us must be sent in writing to the address or email shown in the Imprint.
